These Terms are a contract between you and Kinwyn LLC, a Kentucky limited liability company (“Kinwyn,” “we,” “us”). They apply to the Kinwyn website, progressive web app, and related services at kinwyn.com and www.kinwyn.com. If you do not agree, do not use Kinwyn.
The Privacy Policy explains how we handle personal information. These Terms control the legal relationship.
Contact. Sign in and write us from Support in the app (Account → Support). We do not publish a phone number or a public email inbox.
1. What Kinwyn is (and is not)
Kinwyn is a private household home-search and move-planning app for people in the United States. Households compare homes, share ratings and must-haves, and track tasks and move costs.
Kinwyn is not: a real estate broker, salesperson, or brokerage; an appraiser, appraisal management company, or inspector; a lender, mortgage broker, or insurance agent; a multiple listing service, IDX site, or public listing search; a party to any purchase, sale, or lease.
Nothing on Kinwyn is an offer, solicitation, or commitment to buy or sell property. We do not negotiate for you, collect referral fees, or contact listing agents or owners on your behalf.
If you need brokerage, appraisal, inspection, or lending, hire a licensed professional in the property’s state.
2. Who may use it
You must be 18 or older and able to form a contract. The service is built for the United States (U.S. addresses, USD, U.S. sources).
One person creates a household. Others join only with an invite link that household controls. You are responsible for everyone you invite and for keeping the invite link private.
We may refuse, suspend, or close an account if these Terms are broken or if we have to for security or law.
3. Your account
Give accurate account information and keep your password or Google sign-in under your control. You are responsible for activity under your account.
If you use Google sign-in, Google’s terms and privacy policy also apply to that sign-in.
If you think someone else got into your account, write us from Support in the app (Account → Support).
4. How homes get into Kinwyn
You add a home by typing a U.S. street address or by pasting listing facts or a listing URL (for example Share → Copy text).
Kinwyn reads only what you paste or type. We do not open, fetch, scrape, or crawl Zillow, Redfin, Realtor.com, Homes.com, Trulia, broker sites, or MLS systems.
A pasted listing URL is stored so you can click “View listing.” That click leaves Kinwyn. We do not load the listing page on our servers.
When a licensed vendor returns listing photos for a home you added, we may show those photos to your household. You cannot upload photos. Pasted listing-portal image hosts are blocked.
You represent that you have the right to paste the text you paste. Do not paste content you know you are not allowed to copy.
If the paste includes an agent name, brokerage, MLS ID, or marketing remarks, that is your paste, shown only to your household. It is not Kinwyn republishing a live MLS feed.
5. Facts, maps, and AI
After you save a home, we may: geocode with the U.S. Census geocoder; fill empty parcel fields from a licensed vendor; add official government facts (for example FEMA); write a short AI summary of stored fields only.
We do not fetch the listing URL. AI is not allowed to browse or invent facts. No number on Kinwyn is an appraisal. We do not create crime scores, school ratings, or neighborhood-quality scores.
You agree to check the live listing, official records, and your own professionals before you act.
6. Your content
“Your Content” means addresses, pastes, notes, comments, ratings, must-haves, tasks, costs, and anything else you or your household put into Kinwyn.
You keep whatever rights you already have in Your Content. You grant Kinwyn a limited license to host, display, and process it inside your household, and to send the stored fields to our processors (geocoder, licensed data vendor, government APIs, and a model that writes a summary), solely to operate the service.
You will not paste content you do not have the right to use; listing-portal photos; Social Security numbers, full payment card numbers, or account passwords; owner, occupant, or tenant phone numbers or emails collected for outreach; illegal, harassing, or discriminatory content (including Fair Housing violations); or malware.
We may remove content that breaks these rules. Household comments are not public reviews of a property or an agent.
7. Acceptable use
You may use Kinwyn only for your household’s private move planning.
You may not scrape, crawl, or bulk-export Kinwyn; resell or republish Kinwyn data; try to fetch listing sites through our servers; use Kinwyn to contact owners, occupants, or agents; use Kinwyn to discriminate in housing on a basis protected by the Fair Housing Act or state law; hold Kinwyn out as your broker; bypass rate limits or probe other households; or use an automated system to add homes you are not actually considering.
Licensed vendor data and government data may have redistribution limits. You may not harvest those fields to build another product.
8. Plans and payment
Kinwyn offers a Free plan and a paid Household plan. Current Household prices are $12 per month or $79 per year, in U.S. dollars, as shown at checkout. Taxes may apply.
The paid subscription belongs to the household, not to one person. Only a household manager can start, change, or cancel billing. Other household members may use Household features while the subscription is active.
Paid checkout is processed by Stripe. We store Stripe customer and subscription identifiers. We do not store full card numbers. Fees are due in advance for the monthly or annual period you choose. If you do not cancel, the plan renews at the then-current price.
You can cancel future renewals from Subscription in Account, including Stripe’s Customer Portal. After you cancel, Household stays unlocked until that period ends. Fees already paid are not refunded except where the law requires it or we say otherwise at checkout. We may change prices with notice before the next renewal.
We do not take real-estate commissions or referral fees through Kinwyn.
9. Third-party services and outbound links
“View listing,” virtual-tour links, map tiles, Google sign-in, and similar features send you to or through other companies. Their terms apply. We are not responsible for those sites.
Map tiles (for example Esri satellite imagery) and fonts are provided by their operators under their licenses. We do not grant you a right to scrape those providers.
10. Intellectual property
Kinwyn, the name, the app, and our original design and software are owned by us and our licensors. These Terms give you a personal, non-exclusive, non-transferable right to use the service while your account is in good standing. They do not sell you the software.
You may not copy the product, reverse engineer it except where the law says you may, or remove our notices.
If you believe content on Kinwyn infringes a copyright, send a notice from Support in the app (Account → Support), or mail it to the address in section 19, with your contact information, the work claimed to be infringed, the exact material and its location, a good-faith statement, and your signature. We will respond as the statute requires. If we later designate a registered DMCA agent, we will put that name here.
11. Disclaimers
KINWYN IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that any address, price, bed count, tax figure, flood zone, school name, map, photo, or AI summary is accurate, complete, or current; that licensed vendor or government data is correct; or that the service will be uninterrupted or error-free.
Property decisions have real consequences. You assume the risk of relying on anything you see in Kinwyn.
Some states do not allow certain warranty disclaimers. In those states, we disclaim only as far as the law allows.
12. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, KINWYN LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR THE COST OF A HOUSE, A FAILED TRANSACTION, OR A MOVE, EVEN IF WE WERE TOLD THAT KIND OF LOSS WAS POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR KINWYN IN THE 12 MONTHS BEFORE THE CLAIM OR (B) TWENTY-FIVE U.S. DOLLARS ($25).
These limits do not apply to liability that the law says we cannot limit.
13. Indemnity
You will indemnify and hold us harmless from claims, damages, and reasonable legal fees that arise out of Your Content; your misuse of the service; your violation of these Terms or of a listing site’s terms when you copied text; or your use of Kinwyn in a real-estate transaction (including any claim that we were acting as your broker). We will notify you of a claim and you will cooperate. We may choose our own counsel at our expense if we want to control the defense.
14. Fair Housing
You agree not to use Kinwyn to discriminate against any person in housing on the basis of race, color, religion, sex, disability, familial status, national origin, or any other status protected by federal, state, or local law. We may remove content or close accounts that violate this rule.
15. Termination
You may stop using Kinwyn and delete your account at any time. Canceling a paid Household plan does not by itself delete the household; it stops renewal after the current period.
We may suspend or end access if you break these Terms, if we discontinue the product, or if we must for law or security. We will try to give notice when it is reasonable.
On termination, your license ends. Sections that should survive (including 4 through 7 and 10 through 18) survive.
16. Changes
We may change features, including data sources and whether AI summaries are on. We may also update these Terms. We will change the date at the top and, for a material change, notify you in the app or by email. If you keep using Kinwyn after the new Terms take effect, you accept them. If you do not, delete your account.
17. Governing law and disputes
These Terms are governed by the laws of Kentucky, without regard to conflict-of-law rules, and by U.S. federal law where it applies.
Courts located in Kentucky will have exclusive jurisdiction, except that either side may seek injunctive relief in any court for unauthorized access or misuse of the service.
If you are a consumer, you also keep any non-waivable rights your state gives you. These Terms do not require arbitration.
18. Miscellaneous
These Terms are the entire agreement about the service. If a section is unenforceable, the rest stays in force. We may assign these Terms in a sale of the service. You may not assign them without our consent. A failure to enforce a section is not a waiver. People in your household are bound by the same use rules when they accept an invite. Headings are for reading convenience only.
